Alcoholic Beverage Control Ruling Tuesday July 20, 2004
Dear Mr. Tottress, Thank you for responding to my inquiry. As per our phone conversation last Thursday afternoon, July 15, here is a detailed synopsis on my business proposal and request. The questions are "Will my company fall under the jurisdiction of your agency?", "Will it need to apply for a license?", "What is the category or type, and associated fees?", and "If needed, how long will it take?". The company is domiciled and registered in Nevada as an internet service. However, my suppliers are all here in Southern California. Computer terminal operations for compiling orders, and overseeing corporate operations are conducted out of an office in my residence, located in Perris, CA 92571. My company will be obtaining a California resale license. The Nevada Secretary of State's office has indicated I need no licensing under their jurisdiction, (except to register for use tax on any product potentially shipped into Nevada) since my purchasing and shipping service for my customers will physically be conducted in California. The concept For TemeculaWinesOnLine.com is quite simple. On the company's website will be featured all the wine varietals produced by each of the wineries in and around what is considered as Temecula Valley Wine Country, located generally in south Riverside County, and some in northern San Diego County. This encompasses about 30 wineries. Our site will also offer wine reviews by us, and an opportunity for reviews by our customers. When you enter the site, one must pass thru an acknowledgement of legal age restrictions, as well as legal state shipping restrictions. One then enters our home page in shopping cart mode, ready for customers to place purchasing service orders. A qualified purchaser can then place an order for any mixture of available featured wine, which will reflect the wineries' respective retail price. We then go directly to each winery and purchase each wine in the order at retail for our customer, and pass that price directly to them with NO markup. It is then immediately properly packaged and shipped. The customer is then charged a flat fee for the purchasing service, plus the cost of shipping, and their payment processed at the time of shipping thru our virtual merchant account. That is it! I look forward to the results of your investigation and communication to me, hopefully, very soon (your case load permitting, of course). Thank You!
